1. Provider and seller
The Dascali website (dascali.com) is published by Conservatoire Augmenté, a French simplified joint-stock company (société par actions simplifiée) with a share capital of EUR 10,000, registered with the Paris Trade and Companies Register (RCS) under number 981 985 641, EU VAT number FR05981985641, whose registered office is at 209 avenue Jean Jaurès, 75019 Paris, France, represented by François Gerber, Chief Executive Officer (Directeur Général). Place of business: 8 avenue du Nouveau Conservatoire, 75019 Paris, France. Contact: support@conservatoireaugmente.com.
The Courses are sold in the name and on behalf of the Conservatoire national supérieur de musique et de danse de Paris (CNSMDP), a French public administrative institution under the supervision of the Ministry of Culture, whose registered office is at 209 avenue Jean Jaurès, 75019 Paris, France, under an agency agreement. The contract of sale is concluded between you and the CNSMDP. Conservatoire Augmenté (“we”, “us”), a subsidiary of the CNSMDP and its agent, designs the Courses, markets them, collects payment, issues invoices, provides access to the Site and runs customer service, and is your point of contact for the whole contractual relationship.
2. Definitions
Site: the website dascali.com.
Course: any distance-learning module or programme offered for purchase on the Site.
Learner: any natural person who purchases a Course for purposes outside their trade, business, craft or profession (a consumer within the meaning of the applicable consumer protection law).
Business Customer: any person who purchases a Course in the course of their trade, business, craft or profession, including any legal entity.
In these Terms, “you” means the Learner or the Business Customer, as the case may be.
Account: your personal area on the Site.
3. Purpose and acceptance
These terms of sale (“Terms”) govern every purchase of a Course on the Site. They prevail over any other document, including your own purchasing terms if you are a Business Customer.
By purchasing a Course, you expressly accept without reservation the Terms in force on the date of payment. Conservatoire Augmenté may amend the Terms at any time; the version applicable to a purchase is the one accepted at the time of that purchase.
If any provision of the Terms is held to be invalid, the remaining provisions remain in full force.
These Terms are also available in French. In the event of any discrepancy between the two versions, the French version prevails, except where the law of your country of residence requires otherwise.
4. Courses
Courses are delivered exclusively online, at a distance. Each Course consists of digital content (videos, texts, sheet music, exercises and online assessments) made available to you on the Site and studied at your own pace. It does not include individual tuition or coaching. Each Course has a description page on the Site setting out its content, objectives, prerequisites, estimated duration, teaching and assessment methods, the technical and educational support available and the technical requirements needed to access it (functionality, compatibility and interoperability).
5. Account
Access to the Courses requires the creation of an Account, which is reserved for persons who have reached the age of majority in their country of residence (18 in most countries) or who are duly authorised. You provide your first name, surname, email address, postal address and telephone number. If you are a Business Customer, you also provide your company name, billing address and your company registration or VAT number. You warrant that this information is accurate and keep it up to date.
The Account is strictly personal. You keep your login details confidential, do not share them with anyone and are responsible for all use of your Account. If you suspect unauthorised use, you change your password without delay and inform Conservatoire Augmenté.
The internet connection, hardware and software needed to access the Courses are your responsibility. Before any purchase, you check that they meet the technical requirements stated on the Course page.
6. Ordering
Orders are placed online: selection of the Course, login to or creation of your Account, review of the order summary with the possibility of correcting any errors, acceptance of the Terms, express waiver of the right of withdrawal if you want immediate access (section 9), then payment. The contract may be concluded in French or in English.
The order becomes binding once payment is validated. A confirmation is sent to you by email, setting out the Course, its price, the Terms accepted and, where applicable, your waiver of the right of withdrawal. The order is archived and remains available in your Account for the duration of your access to the Course.
7. Prices and payment
Course prices are shown on the Site in euros and, depending on your country, in pounds sterling, Swiss francs, US dollars or Canadian dollars. For Learners, prices are shown inclusive of all applicable taxes; for Business Customers, prices are shown exclusive of taxes, with the amount of applicable taxes stated before payment. The applicable price is the one displayed in the currency of your order at the time you place it; prices in the various currencies are set by Conservatoire Augmenté and are not the result of a conversion at the daily exchange rate.
Payment is made in a single instalment, by payment card, in the currency of the order, through the secure payment provider Stripe. Conservatoire Augmenté neither collects nor stores payment card data. Any fees charged by your bank (currency conversion, foreign transaction fees) are your responsibility. An invoice is sent to you by email after payment and remains available in your Account.
8. Access to the Course
Access to the Course opens as soon as payment is validated or, if you are a Learner and have not waived your right of withdrawal, at the end of the withdrawal period. You access the Course from your Account, at any time, for a period of 365 days from the date access opens. This period is stated on the Course page. A CNSMDP certificate is available in your Account at the end of the Course.
Conservatoire Augmenté endeavours to keep the Site available at all times. It may nevertheless temporarily interrupt access for maintenance or updates, informing you where possible. Interruptions caused by your internet connection, your equipment or an event beyond our reasonable control (force majeure) do not give rise to any compensation.
Conservatoire Augmenté may update the content of a Course to keep it accurate and of high quality, without altering its purpose.
9. Right of withdrawal
If you are a Learner, you have fourteen days from the validation of your order to withdraw from the contract without giving any reason. This right is granted by law if you reside in the European Union, the European Economic Area or the United Kingdom, and on a voluntary basis by Conservatoire Augmenté if you reside elsewhere, without prejudice to any right that the mandatory law of your country of residence grants you.
You exercise this right by using the “Withdraw from contract here” function in your Account, by email to support@conservatoireaugmente.com or by post, using the model form available in the Support section. Conservatoire Augmenté sends you an acknowledgement of receipt without delay. Refunds are made within fourteen days of receipt of your request, using the payment method and currency used for the order, for the amount paid.
As the Course is digital content not supplied on a tangible medium, if you request immediate access you expressly acknowledge and agree at the time of ordering that performance of the contract begins before the end of the withdrawal period and that you consequently lose your right of withdrawal as soon as access opens.
The right of withdrawal does not apply to Business Customers.
10. Legal guarantees
If you are a Learner, you benefit from the legal guarantee of conformity applicable to digital content under the law of your country of residence (in the European Union and the European Economic Area, the national provisions transposing Directive (EU) 2019/770; in the United Kingdom, the Consumer Rights Act 2015), and from any other guarantee that the mandatory law of your country of residence grants to consumers. Nothing in these Terms excludes or limits those guarantees. Any claim under these guarantees is sent to customer service (section 13).
11. Intellectual property
The Site and the Courses (texts, videos, sounds, sheet music, images, exercises, software, trade marks and logos) are protected by intellectual property law. The CNSMDP and Conservatoire Augmenté own them or hold the rights to exploit them.
Purchasing a Course grants you a personal, non-exclusive and non-transferable right of access, limited to the access period and to private use or individual professional training. Any reproduction, downloading not provided for on the Site, distribution, sharing of access, resale or commercial exploitation, in whole or in part, is prohibited.
In the event of a breach, Conservatoire Augmenté may suspend or close your Account, without prejudice to any claim for damages.
12. Liability
The CNSMDP, as seller, and Conservatoire Augmenté, as agent, undertake to use reasonable skill and care in the teaching quality of the Courses. They do not guarantee any particular professional or artistic result. They are not liable for loss or damage resulting from use of the Site or the Courses that does not comply with these Terms, from a breach of your obligations, or from an event beyond its reasonable control.
13. Complaints and mediation
Any complaint is sent to customer service by email at support@conservatoireaugmente.com or by post to Conservatoire Augmenté, 8 avenue du Nouveau Conservatoire, 75019 Paris, France. Conservatoire Augmenté replies within fifteen working days.
If you are a Learner, wherever you reside, and your written complaint has not received a satisfactory response within two months, you may, in accordance with the provisions of the French Consumer Code on the consumer dispute mediation process (Articles L612-1 et seq.), refer the dispute free of charge to the consumer mediator appointed by Conservatoire Augmenté:
CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice) 49 rue de Ponthieu, 75008 Paris, France Telephone: +33 1 89 47 00 14 Website: https://www.cm2c.net/declarer-un-litige.php Email: litiges@cm2c.net
Mediation is voluntary and does not prevent you from bringing proceedings before the courts.
14. Personal data
Your personal data are processed in accordance with the Site’s Privacy Policy, which sets out the purposes of processing, retention periods and how to exercise your rights. The Data Protection Officer can be contacted at dpo@conservatoireaugmente.com.
15. Governing law and disputes
These Terms are governed by French law. If you are a Learner residing in another country, this choice of law does not deprive you of the protection granted by the mandatory consumer protection provisions of the law of your country of residence.
If you are a Learner, you may bring proceedings before the competent courts of France or of your country of residence, and Conservatoire Augmenté may bring proceedings against you only before the courts of your country of residence. For Business Customers, disputes are brought before the courts having jurisdiction under the ordinary rules of French law.
